“Miqdad, the son of Aswad asked the Messenger of Allah, praise and peace be upon him, ‘Tell me, if I am fighting an unbeliever and he cuts off one of my hands with his sword and then takes refuge behind a tree (fearing revenge) and says: I submit to Allah, should I kill him after he has said this?’ He replied: ‘No, do not kill him.’ Miqdad inquired: ‘O Messenger of Allah, praise and peace be upon him, even after he had cut off one of my hands and then said this?’ The Prophet, praise and peace be upon him, explained: ‘Do not kill him, because if you do he will assume the position you held before you killed him, and you would assume the position he held before he pronounced those words.’"
